I can't really see what's rubbing, but this photo looks pretty 
normal. If it's rubbing against the side of the cylinder that sticks 
out the top of the thermostat, you may be able to correct it by 
loosening the nut that attaches the bracket to the case and rotating 
it slightly.

If you're concerned that the thermostat runs into the top of the 
bracket when warm, that's completely normal.

It does appear that the top of the thermostat isn't parallel to the 
bottom in your photo. That might be due to the vertical pushrod being 
bent. It's supposed to have a couple bends in it, but the top and 
bottom sections should be parallel.
